POL - Local Preference

This document is a section from the City of Tallassee Code of Ordinances, specifically Chapter 2, Article X, which pertains to the local preference policy in purchasing and contracting. According to Section 2-201, the city commission or other purchasing authority has the discretion to give a preference to local businesses when making purchases or awarding contracts. The preference can be up to 5% for purchases under $250,000, 3% for purchases between $250,001 and $500,000, and 2% for purchases over $500,000. The cost differential should not exceed $25,000. The total bid price includes the base bid price and any alterations resulting from alternates. However, there are exceptions to this local preference policy as outlined in Section 2-202. The preference does not apply to purchases or contracts with an estimated value of $10,000 or less, contracts for professional services subject to certain procurement acts or selection procedures, purchases or contracts funded by a governmental entity with regulations prohibiting the preference, and purchases or contracts made under emergency procurement situations. The document also provides a definition for "local business" in Section 2-203. A local business is defined as a person, firm, corporation, or other business entity that is licensed and authorized to engage in the specific business and has a permanent place of business with full-time employees in Leon, Wakulla, Gadsden, or Jefferson County, Florida, for at least six months prior to the date bids were received for the purchase or contract.
