This document is an Invitation for Bid (IFB) issued by the City of Newport News. The City is acting as a contracting agent and is not responsible for placing orders, making payments, or resolving discrepancies for participating jurisdictions. Contractors are responsible for notifying jurisdictions of contract availability. Prices should be stated in the specified units of quantity, and no additional charges should be passed on to the City. Mistakes in pricing can be crossed out and corrected, and the unit price will govern in case of errors. The proposed delivery time must be clearly stated, and samples, if requested, should be provided free of expense. The use of specific manufacturer names or brands does not restrict bidders to those options, as long as the goods or services meet the specified requirements. Bids on alternate goods will be considered if they serve the best interests of the City. Equipment delivered must be new and unused, and all necessary accessories should be included unless otherwise stated. The specifications should be interpreted based on the best commercial practices. Bids must be signed by a responsible officer or employee, and the bidder agrees to perform the contract in strict conformance with the contract documents. By signing the bid, the bidder assigns any antitrust rights to the City. The bidder certifies that the bid is made without any prior understanding or agreement with other bidders and is not the result of fraud or collusion. The contractor is required to defend, indemnify, and hold the City harmless from any damage, claim, liability, cost, or expense arising from the performance of services. The contractor must comply with all applicable laws, ordinances, and regulations. The contractor must not knowingly employ unauthorized aliens. Bidders or offerors organized or authorized to transact business in the Commonwealth must include their identification number issued by the State Corporation Commission. Any business entity entering into a contract with the City must maintain its existence and required authorization throughout the contract term. The City reserves the right to revoke or cancel the contract at any time during its term and may void any contract with a business entity if the specified conditions are not met.
