The document is an agreement between the Sheriff's Office and the Florida Counter-Drug Procurement Program (FLCDPP) for the procurement of law enforcement equipment under the United States 1122 Program. The Sheriff's Office will submit procurement requests to the FLCDPP office along with the necessary documentation validating the counter-drug mission for each request. The FLCDPP office will then submit the requests on behalf of the Sheriff's Office. The Sheriff's Office is responsible for the payment of all costs associated with the procurement requests and must submit a purchase order for the exact amount at the time of ordering. The Sheriff's Office is also responsible for the receipt, inspection, and acceptance of all equipment, materials, and services ordered. The Sheriff's Office has the exclusive right to exercise any rights or remedies, and failure to secure performance under a purchase order does not require another entity to exercise its own rights or remedies. The procurement of equipment through the 1122 Program must comply with the terms and conditions set by the federal agency, with the exception of modifications allowed by law. The selection of equipment to be ordered is at the discretion of the Sheriff's Office, but it must be used for counter-drug related activities. The FLCDPP office is not liable for any violations by the Sheriff's Office and the Sheriff's Office agrees to hold FLCDPP harmless from any liability. Either party may terminate the agreement if the other party fails to comply with the terms, or either party may terminate the agreement with or without cause upon 30 days notice. The parties are authorized to enter into this agreement under Chapter 217 of the Florida Statutes. Notices under the agreement should be sent to the specified addresses. The document also includes a memorandum of modification, which states that the agreement will be modified to include the newly elected Sheriff's approval if the terms and conditions extend beyond January 2005.
