This document is a section of the Code of Virginia that outlines regulations and penalties related to public procurement. It prohibits individuals from demanding or receiving payments or anything of value in return for an agreement not to compete on a public contract. If a subcontractor or supplier makes a prohibited payment, it is presumed to have been included in the price of the subcontract or order and can be recovered from both the maker and recipient. The document also states that individuals who prepare bid invitations or proposals for a public body cannot submit a bid for the same procurement or disclose non-public information to bidders, unless the public body determines that excluding them would limit the number of potential qualified bidders. It further prohibits the purchase of building materials from architects or engineers employed by the public body or with personal interests in such transactions. However, these provisions do not apply in cases of emergency or transportation-related projects. Public employees involved in procurement transactions may be required to submit written certifications of compliance, and making false statements in these certifications is punishable. Misrepresentations or fraudulent actions by public employees in procurement transactions are also prohibited. Violations of these regulations can result in a Class 1 misdemeanor and forfeiture of employment.
