The County's Right-Of-Way Department will provide instructions for correcting any unsightly or hazardous conditions created during the removal or demolition process. To ensure a satisfactory clean-up, the purchaser is required to submit a performance deposit, which will be returned when the clean-up work is deemed satisfactory. Failure to comply with the terms of the agreement within the specified time will result in the sale being null and void, and all money paid by the purchaser will be forfeited as liquidated damages. The salvage rights to the mobile homes cannot be resold without written consent from the County until they have been removed from County property and adjacent streets. The purchaser is required to protect and hold harmless the County and its authorized agents and employees from any claims, actions, costs, damages, or expenses arising from the acts or omissions of the purchaser or its agents, contractors, employees, or any other person authorized by the agreement. The purchaser also agrees to defend the County in any litigation related to the acts or activities authorized by the agreement. The contract documents consist of the Agreement, the Notice of Sale of Mobile Homes by sealed bid document, and the bidder's Proposal documents. In case of any inconsistency between the provisions of the Agreement and the Proposal, the provisions of the Agreement control.
