This document is a contract agreement between a contractor and Baltimore County. The contractor is required to comply with all the terms, conditions, and obligations of the agreement, including the specifications and any special requirements that may be appended to it. The scope of work includes providing labor, materials, supervision, equipment, services, and related items necessary to complete the work. The contractor is responsible for notifying the relevant authorities, such as the RPCPC (Regional Planning and Capital Programming Committee), in case of delays that are not their responsibility. They are also responsible for investigating and reporting any complaints related to the use of their materials and supplies. All materials furnished and installed under the contract are guaranteed for a minimum period of one year against any defects in material, workmanship, and installation. Inquiries regarding the bid should be directed to the Buyer, Kathy Madary. The County reserves the right to issue a contract release order or solicit bids on the open market for proposals of $25,000 or greater. For proposals under $25,000, the contractor will be issued a Contract Release Order if approved by the Purchasing Agent or authorized representatives. The successful offeror is required to provide evidence of insurance within fifteen calendar days. Failure to comply may result in the contract being awarded to the next lowest responsive and responsible bidder. The contractor must maintain the required insurance coverages while the agreement is in force. Invoices must be accompanied by daily work tickets and copies of manufacturer's/vendor's invoices for materials used. Invoices must be submitted on a monthly basis to the Office of Finance, Disbursements Section. The County may withhold or nullify payment for various reasons, including defective work, claims filed by parties other than the contractor, failure to make payments to subcontractors or for materials or labor, and reasonable doubt about completing the contract. The contractor remains responsible for faulty materials and workmanship even after final payment. The County must be promptly notified of any observed defects during the guarantee period. The final payment or retained percentage will not become due until the contractor provides a complete release of all liens arising from the contract. If any liens remain unsatisfied, the contractor must refund the County all necessary payments. The contract resulting from this solicitation must be approved and signed by the Baltimore County Administrative Officer, which typically takes four weeks. The County's standard contract is attached, and any exceptions must be noted in the proposal submission. The contractor is not allowed to assign the contract or sublet it by trades or portions exceeding 50% of the monetary value. The remaining 50% must be executed directly by the contractor. The contractor also cannot assign any monies due without written consent from the County. The County reserves the right to extend the terms, conditions, specifications, and prices of the contract to other public bodies, subdivisions, schools, colleges, and universities, subject to mutual agreement.
