The Contractor is also required to indemnify and hold harmless the Metropolitan Government against any damages and costs awarded in such cases. 7. The Contractor has the option to procure the right to continue using the products or services, replace or modify the alleged infringing products or services, or remove the products or discontinue the services if they are found to infringe on copyright, patent, or trademark rights. However, options (B)(1) and (B)(2) should be considered before exercising option (B)(3). 8. The document provides contact information for sending notices to the Metropolitan Government and the Contractor. The Contractor is required to designate an agent for service of process. 9. Any Metropolitan Government property in the possession of the Contractor should be maintained in good condition and returned upon termination of the contract. All work product and property produced during the performance of this contract are deemed to be Metropolitan Government property.
