  • YEAR CREATED: 2007
  • ENTITY TYPE: County
  • TYPE OF DOCUMENT: BID - ITB, IFB, ITT, RFB
This document provides information regarding invoices, liens, employees, the relationship between contractors and subcontractors, and minority and women business enterprise requirements in the context of a construction project in Baltimore County. Regarding invoices, it states that the contractor must clearly state a complete description of work performed, location, and date on their invoices. The invoices should be signed by the engineer or their authorized representative at the job site, with one copy given to the contact person and one retained by the contractor. Authorization to pay invoices will be given by the using agency prior to payment. Cash discounts will be calculated from the date of delivery and acceptance of goods or the date of receipt of correct and proper invoices, whichever is later. Interest will not be paid under any circumstances. Baltimore County has the right to withhold or nullify payment to the contractor if there is evidence of defective work, claims filed by parties other than the contractor, failure to make payments to subcontractors or for materials or labor, reasonable doubt about the completion of the contract, damage to another contractor, or failure to submit required data within specified time limits. Once the grounds for withholding payment are resolved, the withheld amount will be paid. The contractor is responsible for correcting any faulty materials and workmanship even after final payment. The county will notify the contractor of any observed defects within a reasonable time. The document also addresses liens, stating that final payment or the retained percentage will not be due until the contractor provides a complete release of all liens arising from the contract. If any liens remain unsatisfied, the contractor must refund the county all the money it had to pay to discharge the lien. Regarding employees, the contractor must ensure that only trained and skilled personnel are employed for the work. Licensed personnel must be employed when required by laws. The contractor must confine operations to the specified work areas and maintain a competent superintendent and necessary assistants on the job. The contractor must enforce discipline and good order among employees and comply with instructions related to water, heat, power, smoking, and fires. Employees must not loiter on the premises before or after working hours. The relationship between the contractor and subcontractor is outlined, stating that subcontractors must be bound by the terms of the agreement and assume obligations and responsibilities towards the county as specified in the documents. The document also includes requirements for minority and women business enterprise participation. Contractors must comply with these requirements and submit completed M/WBE participation forms. Payments to M/WBE subcontractors and suppliers must be submitted to the Minority Business Enterprise Officer during the contract term. It is mentioned that the contract resulting from this solicitation must be approved and signed by the Baltimore County Council, which typically takes six weeks. Contractors should note any exceptions to the County's standard contract in their proposal submission. A sample standard contract is attached for review.
