The document outlines various terms and conditions that bidders must adhere to in order to be considered for the contract. Some key points mentioned in the document include: - If any errors or omissions are discovered in a bid document, the vendor may request to withdraw their bid, provided they provide sufficient evidence that the error or omission was unintentional. - Any additional terms and conditions included with the bid response will not be evaluated or considered. - If a bidder fails to enter into a contract with HCPS based on their submitted bid, they will be liable to HCPS for the difference between their bid price and the price HCPS pays to secure the merchandise from another source. - Offering gratuities or kickbacks to HCPS employees or subcontractors as an inducement for award of a bid will result in disqualification of the bidder's proposal. - Prices stated in the bid must be in the specified units, and in case of a discrepancy between the unit price and the extension, the unit price will be considered correct. - HCPS reserves the right to reject any and all bids, and to waive any defect, irregularity, or informality. - HCPS may terminate all or part of a contract if it is in the best interest of HCPS, with a minimum of thirty days notice, except for contracts impacting security. - If a bidder defaults after being awarded a bid, they may be required to pay liquidated damages equal to 5% of the unit price times the ordered quantity or 5% of the total value of the item or bid, whichever is greater. - HCPS reserves the right to terminate the contract if the vendor fails to make delivery or perform the contracted services within the specified time, with a ten-day remediation period. - If sufficient budgeted funds are not available, the contract may be terminated without penalty or expense to HCPS. - Only trade-named items specified in the bid document will be considered, unless otherwise indicated. - All items requested must be new and the latest model manufactured, unless otherwise specified. - Samples of items, when required, must be furnished free of expense and may be returned at the bidder's expense. - HCPS encourages the participation of small and minority-owned businesses in the provision of goods, services, and construction. - Delivery is typically scheduled between 8:00 a.m. and 3:00 p.m. on weekdays, excluding HCPS holidays.
