This document provides information regarding inquiries, invoices, correction of work, assignment, liens, Maryland state sales tax, employees, relation of contractor and subcontractor, disputes, and MBE requirements in the context of a bid. Inquiries regarding the bid should be directed to Stephen P. Myer, the Buyer. Invoices must be accompanied by daily work tickets and should be legibly prepared, showing the full description of work performed and the unit price for each payment unit of measure. Authorization to pay invoices will be given by the Engineer. Invoices must be submitted in duplicate to the Office of Finance and a copy must be submitted to the Engineer. Charges for late payment of invoices are prohibited. Baltimore County may withhold or nullify payment to protect against defective work, claims filed by parties other than the Contractor, failure to make payments to subcontractors or for materials or labor, reasonable doubt about completing the contract, damage to another Contractor, or failure to submit required data on time. Once the grounds for withholding payment are resolved, the withheld amounts will be paid. The Contractor is responsible for correcting any faulty materials and workmanship even after final payment. The County will notify the Contractor of observed defects within a reasonable time. The Contractor is not allowed to assign the contract or sublet it by more than 75% of its monetary value. The remaining 25% must be executed by the Contractor directly. The Contractor cannot assign any monies due without written consent from the County. The final payment or retained percentage will not become due until the Contractor delivers a complete release of all liens arising from the contract. If any liens remain unsatisfied, the Contractor must refund the County all monies paid to discharge the lien. Contractors performing work for the State of Maryland or its political subdivisions must pay tax on materials, supplies, and equipment used in the work. Only trained and skilled personnel should be employed on the work. Licensed personnel should be employed when required by laws. The Contractor should employ sufficient personnel to complete the work within the specified time. The Contractor should confine operations to the specified limits and maintain a competent superintendent and necessary assistants. Strict discipline and good order should be enforced among employees. The Contractor and subcontractors are bound by the terms of the Agreement, Baltimore County's Standard Specifications for Construction, and the General Conditions. Disputes will be resolved through arbitration. If the contract value exceeds $100,000.00, the successful bidder must comply with Minority Business Enterprises (MBE) participation requirements as defined by Baltimore County's Executive Order. Copies of Baltimore County's MBE policy and provisions, and MBE participation schedule forms are included with the solicitation.
