  • YEAR CREATED: 2006
  • ENTITY TYPE: County
  • TYPE OF DOCUMENT: BID - ITB, IFB, ITT, RFB
The document is a sample form contract for a solicitation. It includes various terms and conditions that vendors must adhere to when submitting a bid response. Section 10 states that by submitting a bid response without identifying exceptions, the vendor is acknowledging and accepting all terms and conditions of the form contract. Any exceptions must be submitted in writing. If a vendor's exception alters the county's risk, liability, exposure, or the intent of the procurement, the county reserves the right to deem the vendor non-responsive. Section 11 discusses the insurance, bonds, and other contractual requirements. The successful bidder will be required to provide evidence of insurance and maintain the necessary insurance coverages while the agreement is in force. Noncompliance may result in the contract being awarded to the next lowest responsive and responsible bidder. The successful bidder will also be required to provide performance and payment bonds. Section 12 outlines the requirements for compliance with Minority and Women Business Enterprise (M/WBE) participation. Contractors must comply with all M/WBE participation requirements and submit the necessary forms. Section 13 covers delivery, installation, interruptions, and property protection. It specifies the hours and days during which delivery, repair, and installation can take place. The contractor is responsible for protecting existing and newly installed work and must coordinate with the user agency to minimize interruptions. The contractor must also ensure cleanup and proper use of scaffolding and rigging. All work must conform to safety regulations. Section 14 allows for material substitutes and changes to the contract, as long as they meet or exceed the same properties as the named material. Any changes not covered under the original scope of work must be agreed upon by both the contractor and the county, and any additional costs must be submitted in writing. Section 15 states that the contractor is responsible for removing debris and cleaning work areas. They must keep the premises free of debris and remove any unusable materials upon request. Section 16 states that the contractor cannot subcontract all or any portion of the work assigned under this contract.
