Overview

This session will explain why it is so important that our contracts include critical clauses regarding acceptance, rejection, and disputes. Absent our own clauses, we must rely upon the Uniform Commercial Code (UCC), and we may not like their interpretation. The session will also look at precedent and why knowing case law is so important to how we conduct our business.  


What You'll Learn

After completing this online training session, learners will be able to:
 
1. Determine if the agency contract clauses are sufficient to not have to rely upon the UCC
2. Understand why knowing jurisdictional case law is important to the procurement 
3. Understand why precedent is important to answering protests
 

Presenter Bio(s) 

Professional Certification(s) obtained: NIGP-CPP, CPPO, C.P.M. Experience: Kirk Buffington, is the former Director of Finance and Procurement for the City of Fort Lauderdale, Florida – a position he held until retirement in 2019. He brings 35 years of procurement experience to the profession – including 26 years in public procurement for Florida municipal and county governments. Kirk holds a bachelor’s degree in Business from Florida State University and a Master's Degree in Business Administration with a major in Logistics and Materials Management from Webster University. Kirk is also pursuing a Master's in Legal Studies, from the University of Cincinnati Law School. In service to NIGP Chapters, Kirk has held membership in the Central Florida Chapter of NIGP since 1993 and in the Southeast Florida Chapter since 1995. He has served as the Southeast Florida Chapter Vice President and was the President for two years. Kirk is a Certified NIGP Instructor and served as the President of the National Institute of Governmental Purchasing, Inc. from 2008-2009. In service to the profession, Kirk has also held numerous leadership positions within the Florida Association of Public Procurement Officials (FAPPO) and as its President in 2001. He was also a member of the Local Planning Committee for the 1997 NIGP Forum in Fort Lauderdale.
 

Attendance for Individuals

In order to receive one contact hour, each member needs to register for the webinar individually in advance and then watch the live webinar. Your credit is tabulated by match between your login and your registration.

Attendance for Groups

There is a Group Sign-In Form provided with each webinar. The group sign-in form does not register anyone for the webinar, it just verifies live attendance. Each person will receive their login email on the day of the webinar – this verifies their registration. The group sign in form verifies that they watched the live webinar.

Cancellation Policy

Registration and payment must be received 24 hours prior to the course start date. After this time, registrations will be based on space availability.  A full refund, less a $75 administrative fee will be given for cancellations made in writing 31+ days prior to the seminar date by emailing RegistrationInfo@nigp.org. No refunds are given for cancellations received within 24 hours of the seminar start date. There are no refunds for no-shows. If the seminar is cancelled for any reason, NIGP's liability is limited to the registration fee only.  

Attendee substitutions within the same agency may be done at any time with email notification to NIGP. If attending via scholarship, please provide documentation verifying the scholarship issuer's name and contact information in lieu of payment information.
