BID - Owner Direct Purchases Supplemental Conditions 2010

  • YEAR CREATED: 2010
  • ENTITY TYPE: County
  • TYPE OF DOCUMENT: BID - ITB, IFB, ITT, RFB
The document outlines the responsibilities and arrangements regarding warranties, possession, insurance, and payment for Owner Direct Purchase (ODP) equipment and materials in a construction project. The contractor is responsible for obtaining and managing warranties and guarantees for all materials and products required by the contract. They are also responsible for resolving any repair, maintenance, or damage-repair calls with the appropriate supplier, vendor, or subcontractor. The contractor is required to warranty ODP items as part of their overall warranty obligations. The county retains legal and equitable title to all ODP, and the transfer of possession constitutes a bailment between the county and the contractor. The county purchases and maintains builders risk insurance to protect against loss or damage to ODP. The contractor must purchase and maintain builders risk insurance based on the completed value of the project, less the county's ODP values. The county is not liable for any interruption, delay, defects, or extra costs related to ODP. The contractor is responsible for reviewing invoices from ODP suppliers and approving payment based on their records and any detected defects. Prompt submission of documentation is required for payment to suppliers, and the county will release payment directly to the supplier. At the end of the project, the county will provide a deductive change order for any costs incurred to provide ODP not covered by previous change orders. Salvage materials can be stored, removed from the site at the county's direction, or turned over to the contractor for salvage or disposal.
