The document is an acknowledgement form for the Geotechnical/Geophysical Release. It states that the form must be signed and submitted before obtaining plans and specifications from the Division of Procurement. The form also mentions that CDs will not be released if the form is not signed. The form acknowledges that the attached Geotechnical and/or Geophysical Engineering Report(s) dated 08-03-2009 are being made available to the bidder for informational purposes only. The county provides no warranty as to the accuracy, completeness, or correctness of the reports. The reports were developed for design purposes only. The bidder is required to indemnify and hold harmless the county from any costs, claims, extension of contract time, or liabilities resulting from the use of these reports. The information in the reports should only be used by the bidder to facilitate the preparation of the price proposal and should not be solely relied upon for the preparation of the bid or other incidental costs or additional contract time associated with the construction of the project. The county is not classifying the site by making this information available, and the bidder is advised to perform their own investigation, interpretation, and judgment of the subsurface conditions. If the bidder chooses not to perform their own investigation, they will relinquish the county from any liability, extension of contract time, or cost associated with this decision. The bidder is obligated to make their own interpretation of all subsurface data and satisfy themselves through their own independent investigation. The submission of a bid is considered conclusive evidence that the bidder has satisfied themselves as to the subsurface conditions that could be encountered in performing the work for the project.
